Investigators propose new legislation on market surveillance

Swedac has participated in the expert group for the market surveillance investigation. The investigation is proposing new legislation on market surveillance. The final proposal shall be submitted to the Government by January 2018.

The legislation shall clarify the tasks of the market surveillance authorities by giving them all the same powers and sanction mechanisms. In many cases, this means increased powers compared to today, such as the possibility of anonymous purchases and compensation for the cost of testing.

The legislation shall apply to the market surveillance of both consumer products and products for professional use. Furthermore, it will be applied to both new and used products in both the harmonised and non-harmonised areas. The legislation is proposed to enter into force on 1 January 2019.
